We do not knowingly collect personally identifiable information, including User-Generated Imagery or Biometric Data, from anyone under 18. If we become aware that we have collected personal data from individuals under 18 without verification of parental consent, we will take immediate steps to remove that information from our servers and delete the associated data from our training models.
3. Information We Collect
We collect information in the following categories:
A. Information You Provide Directly
- Contact/Account Data (If applicable): Your name and email address (through Google Single Sign-On - SSO), and your phone number.
- Correspondence: Information you provide when contacting us for support or inquiries.
B. User-Generated Imagery and Associated Biometric Data

- Uploaded Images: These original images are collected, processed, and analyzed.
- Try-On Outputs: The final image results generated by the AI model.
- Biometric Data (Technical Processing Data): Geometric data points, feature vectors, model parameters, and algorithmic representations (e.g., scans of facial or body geometry, or landmarks) derived from the image required for the AI model to work. This Biometric Data is used to identify, measure, and map unique individual characteristics for the sole purpose of providing the Virtual Try-On service and improving our AI models.

5. Specific Policy on Biometric Data and AI Training (Illinois BIPA Compliance)
This section serves as your written notice and written release (consent) as required by the Illinois Biometric Information Privacy Act (BIPA) and governs the collection, retention, and use of your Biometric Data.
A. Written Notice and Specific Purpose:
By selecting the "Virtual Try-On" feature and uploading an image of yourself, you are providing your written release and informed consent. We are collecting and storing your Biometric Data solely for the specific purpose of:
- Performing the Virtual Try-On service in real-time.
- Continually developing, training, benchmarking, and improving our Virtual Try-On AI models, related algorithms, and other current and future products and services.
B. Retention Schedule and Destruction Protocol (BIPA-Compliant):
We have established a retention schedule and guidelines for the permanent destruction of Biometric Data, made available to the public in this policy:
| Data Type | Specific Retention Term | Destruction Protocol |
|---|---|---|
| Active Biometric Data (linked to your account) | Retained until the earlier of: (1) Three (3) years after your last interaction with the Virtual Try-On feature; or (2) Receipt of a valid Opt-Out Request (see Section 5.C). | Permanently deleted from active storage systems and backups within a commercially reasonable timeframe. |
| Biometric Data for AI Training (perpetual license) | Retained indefinitely in an aggregate or de-identified manner. | This data is incorporated into the resulting AI models (derivative works) and cannot be retroactively destroyed or removed from the models themselves. |
C. Perpetual License and Your Right to Opt-Out:
By uploading an image, you grant us and our Third-Party AI Providers a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to retain, use, reproduce, modify, and create derivative works from your Uploaded Images, Try-On Outputs, and Biometric Data ("Training Data") for the purpose of continually training and improving our AI models.
- Your Right to Opt-Out: You have the right to request that your Active Biometric Data not be used for future AI model training. To exercise this right, you must send an email to support@cocogen.ai.
- Effect of Opt-Out: An opt-out request will trigger the destruction of your Active Biometric Data (as per the destruction protocol above), but it does not require the destruction of data already incorporated into the Training Data or derivative AI models, due to the technical impossibility of "un-training" a model.
D. Standard of Care:
We store, transmit, and protect all Biometric Data using a reasonable standard of care within our industry and in a manner that is the same as or more protective than the way we store other confidential and sensitive information we collect.
6. Sharing Your Information
We do not sell, lease, trade, or similarly profit from your Biometric Data or other personal information. We share it with the following parties:
- Third-Party AI Providers: We share your Biometric Data and image data with AI service providers for real-time processing and for model training and improvement, subject to strict confidentiality agreements and BIPA-compliant contractual protections.
- Service Providers: Companies that perform functions on our behalf, such as website hosting and analytics.
- Third-Party Retailers: When you click on a shopping link, you are directed to a third-party retailer. We do not share your personal data with them, but they may collect your data according to their own privacy policies.
- Legal/Government Requests: As required by federal or state law, or in response to a valid warrant or subpoena issued by a court of competent jurisdiction.
7. Cookies and Tracking Technologies
We use cookies to analyze site traffic and remember preferences. You can manage your cookie preferences through your browser settings.
8. Data Retention
We retain Biometric Data (Section 3.B) according to the strict retention schedule in Section 5.B. We retain non-sensitive data (Usage Data, Contact Data) for as long as your account is active or as needed to provide you services and comply with legal obligations.
9. Your Data Protection Rights
Depending on your location, you may have rights including the:
- Right to Opt-Out of AI Training (as detailed in Section 5.C).
- Right of Access: To request copies of your personal data.
- Right to Erasure ("Right to be Forgotten"): The right to request that we delete your personal data (subject to legal exceptions and the perpetual license in Section 5.C).
- Right to Object to Processing: The right to object to our processing of your personal data.
- Right to Private Action (Illinois Residents): Residents of Illinois have the right to seek damages, attorneys' fees, and litigation costs for any violation of the Illinois Biometric Information Privacy Act (BIPA).
To exercise any of these rights, please contact us at support@cocogen.ai.
